Class Action and PAGA Defense

Our class action work includes wage/hour, discrimination, retaliation, sexual harassment, whistle-blowing and wrongful termination. Our attorneys are also well qualified and experienced in handling  California Private Attorneys General Act (“PAGA”) matters. Passed in 2004, PAGA allows both current and former employees to sue their employers for California Labor Code violations.

PAGA filings are not required to meet the same requirements as class action lawsuits. Recent case law may make PAGA claims amenable to binding arbitration, a subject on which Kronick lawyers are well versed and can advise clients. Financial exposure to PAGA civil penalties is often steep and can prove particularly burdensome to small businesses.
