Bankruptcy Debtor/Creditor Rights

Kronick’s skilled bankruptcy attorneys counsel both creditors and lenders navigating evolving business challenges. Our team works with secured lenders, financial institutions, and other sophisticated investors in structuring and restructuring financial products to limit bankruptcy and commercial risks. We also counsel debtor clients declaring Chapter 7 bankruptcy and Chapter 11 bankruptcy, as well as prospective debtors regarding bankruptcy alternatives, including the Assignment for the Benefit of Creditors (ABC) option.

Our clients also include private and public debt and equity holders, creditor committees, equity committees, trustees, examiners, landlords, lenders, financial institutions, and purchasers of assets from troubled companies. We advise clients on the structure and bankruptcy implications of proposed transactions (including mergers and acquisitions), collateralized debt obligations, trade receivables, structured financings and mortgage loans. We successfully navigate key issues related to acquiring businesses in and out of bankruptcy, and counsel investors acquiring debt positions in distressed companies to gain control through bankruptcy reorganization.

Kronick attorneys are qualified to handle all aspects of both sides of the bankruptcy process, and our team includes one of only six Sacramento bankruptcy attorneys certified by the State Bar of California Board of Legal Specialization as Specialists in Bankruptcy Law.

Kronick also has extensive experience in Bankruptcy Litigation.
